do... and of course I used my AMEX card and called them immediately upon
opening the box

Sigh. As a native New Yorker (and someone who used to be in the retail
trade in
the City) I'd like to apologize to everyone on the list who's ever had a
less
than happy experience with the average NYC online boiler room operation.
In the
main, these places are the typical Times Square ripoff joint gone
broadband.

I feel it's safe to say that all of us NYers on the list (Bill, Bruce,
etc.)
would strongly urge you to give the lowball come-ons from these folks a
pass and
_only_ deal with the larger online stores like Buy.com, Zones.com,
Tigerdirect.com, etc.

Andrew, please contact your credit card company immediately and advise
them you
will be returning a defective/used item to Marine Park for a FULL refund
(including shipping and handling) NOT an exchange!

Then contact MP for an RMA. If they run true to form, it will take you
between 2
and 4 hours on the phone to get one and they will attempt to charge you
a
restocking fee, which is illegal in NY for the return of a defective or
"Not as
advertised" item. Stick to your guns and tell them that you have advised
your CC
company that the item they shipped as new is defective/used. Should they
refuse
to accept the return you will simply keep the item AND cancel the sale
with your
CC company and they will be out both the item and the money.

Hopefully you used your AMEX card for the purchase which would make this
matter
completely painless.
