James,
How can you force a retailer to accept a return? While I've not been in the
same situation, it seems there may well be many complications for the buyer.
I've copied some information from CDW's website.
"To return a product at CDW, you'll need to request a Return Merchandise
Authorization (RMA) number"
Key word is "request". A request may be denied.
"In general, CDW accepts returns on merchandise from select manufacturers
within 30 days"
Key words, "in general" and "select"
Same escape clause.
"Please be aware that specific manufacturers have more restrictive return
policies"
Key words, all of them. LOL
More restrictions, caps are theirs, not mine
"THESE TERMS AND CONDITIONS OF SALE AND ANY SALE HEREUNDER WILL BE GOVERNED
BY THE LAWS OF THE STATE OF ILLINOIS, WITHOUT REGARD TO CONFLICTS OF LAWS
RULES"
Translation: Live anywhere but Illinois? Tough. Deal with the laws of the
state in which we are located.
"CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL AND STATE COURTS
LOCATED IN COOK COUNTY, ILLINOIS AND SUBMITS TO THE JURISDICTION THEREOF AND
WAIVES THE RIGHT TO CHANGE VENUE."
Same thing.
Added warranty information:
"Customer understands that CDW is not the manufacturer of the products
purchased by Customer hereunder and the only warranties offered are those of
the manufacturer, not CDW.
In other words, call IBM
"CDW AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ALL WARRANTIES EITHER
EXPRESS OR IMPLIED, RELATED TO PRODUCTS SOLD OR SERVICES PROVIDED BY THIRD
PARTIES OR AFFILIATES OF CDW, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER DOES
NOT AFFECT THE TERMS OF THE MANUFACTURER'S WARRANTY, IF ANY"
Key words: "Disclaim all warranties" "Fitness for a particular purpose"
Heck, the laptop shipped with XP, worked fine, and now the end user is
trying to modify the configuration.
Playing devil's advocate, how is CDW at fault in this one? IBM should stand
up to the plate, or be taken to task.
