I've been reading this thread and I can't withhold my comments any longer.
I am an online merchant and over the years I've sold millions of dollars in
product both online and via direct mail and I deal with these problems
everyday. Chargebacks are a major headache for merchants as well as the CC
processing companies. Here's what's most likely going to happen if Mr
Unhappy Shopper tries to charge back the transaction. The processing company
will charge back the sale because Mr Shopper will feed them some kind of BS
as to how the product he received (or didn't receive) is defective and why
it should be charged back. The processor will charge it back upon request.
The merchant (within a very narrow window) will then follow up with all
documentation that the sale was completed and the merchandise was received
in a timely fashion since Mr Shopper signed for the delivery. At some point
the CC processing rep and the bank rep and the merchant and Mr Shopper will
have a conference call and when all parties understand that Mr Shopper
received the item he ordered in a timely fashion, in perfect working
condition as it was manufactured by IBM, he and his bank rep and the
merchant will be informed by the CC processing rep that his actions
basically amount to attempted theft because virtually everyone in the
transaction has complied with all of their respective oblications and the
fact that his is simply unhappy with his purchase is just too bad and is not
a valid reason for a chargeback.

I had this very same situation last week and I have to deal with them on a
regular basis. The fact is that he cannot return what he received from CDW
which is a new, factory sealed IBM thinkpad. I know that everyone on this
list is aware of the value of a new, sealed unit. As Bruce said earlier,
when you drive it off of the lot or in this case, open the box, it's no
longer new. So returning what he received is just not possible and CDW
should not be expected to take that loss. I agree that he may be un happy
with his new thinkpad not being able to be fully functional under Win2000
but seeking a CC chargeback is not the answer. I agree with the path of
finding another DVD/CDRW or upgraded firmware as the best answer to this
problem or adapting to WinXP. In short, grow up, accept your responsibility
and fix the problem you created. Flame me if you want but those gentlemen,
are the facts.
